EpicGO Terms of Service
1. Introduction
EpicGO S.R.L. (“EpicGO”, “we”, or “us”) provides an online car sharing platform connecting vehicle owners with individuals seeking to book those vehicles. The EpicGO platform includes websites, blogs, mobile applications, and associated services, collectively termed "the Services". By accessing or using these Services, communicating with EpicGO or other users, you agree to comply with and be legally bound by these Terms of Service (“Terms”), regardless of registration status. These Terms govern your access to and use of the Services and constitute a binding legal agreement between you and EpicGO.
EpicGO also provides a Car Sharing Agreement summarizing reservation terms between host and guest, accessible through the Services for current or previous bookings and usable as proof of reservation. EpicGO acts as a facilitator for the transactions between the person that books a vehicle on the Services (“guest”) and the vehicle owner that lists a vehicle for booking on the Services (“host”). EpicGO is however not a party to any Car Sharing Agreement entered into between hosts and guests and does not act as an agent for either party. Accordingly, EpicGO shall not be responsible for, nor guarantee, the performance or fulfillment of any obligations arising from or connected to the Car Sharing Agreements between hosts and guests.
2. Modification
EpicGO reserves the right, at its sole discretion, to modify the Services or these Terms at any time. Modifications will be posted on the platform. Continued access or use of the Services after modifications indicates acceptance. If the modified terms are unacceptable, you must cease using the Services and close your EpicGO Account.
3. Eligibility, Registration, Verification and Booking
3.1. Eligibility
The Services are exclusively available to guests meeting the eligibility requirements set forth herein in the booking location and hosts aged 18 or older.
3.2. Registration
To access certain Services, users must create an EpicGO Account by providing accurate and complete information such as name, email address, mobile phone number, and password. Guests and hosts must provide additional required information during the booking or listing processes. All account information must be kept up to date. EpicGO may impose additional booking requirements, including deposits or payment authorizations.
3.3. Verification
EpicGO may, at its discretion, conduct screenings, identity verification, background checks, and vehicle detail verifications. However, EpicGO does not endorse any vehicle, user, or user's background, nor does it guarantee undertaking specific screenings. Hosts bear sole responsibility for vehicle safety, operability, legal registration, and title status.
3.4 Booking Process and Payment
When a guest identifies a vehicle they wish to book, they may select their preferred dates through the calendar provided within the Services, submitting a booking request to the host. Upon receiving this request, the host will review and confirm availability. Following the host's confirmation, the guest will receive a notification via the Services prompting payment of the applicable booking fee. Once the guest has successfully paid the booking fee, they will gain access to the host's contact information and detailed booking particulars. Guests understand and agree that until the booking fee has been paid in full, the reservation remains unconfirmed, and the host's details will not be made available.
If you are a consumer under applicable law, you generally have a 14-day right to withdraw from distance service contracts. However, by requesting that EpicGO begin performing immediately (by processing the booking and disclosing the host’s contact details) you waive the right of withdrawal once performance is complete.
3.5 Agreement between host and guest
Following payment of the booking fee and access to the host’s contact details, the guest and host are to enter into a Car Sharing Agreement to agree between them and formalize the terms of the vehicle use. This agreement may be concluded using the standard Car Sharing Agreement template provided through the Services or, alternatively, the parties may agree to use a different written agreement of their own choosing. EpicGO does not review, validate, or become a party to such agreements and bears no responsibility for their content, legality, or enforcement.
4. User Commitments
Users agree to comply with these Terms, applicable laws, and other EpicGO standards or policies. Users are responsible for all activities under their EpicGO Account and must secure their account details, promptly notifying EpicGO of any unauthorized use.
5. Content
5.1. EpicGO and User Content License
EpicGO grants users a limited, revocable, non-exclusive, non-transferable license to access and view permitted EpicGO/user content for personal, non-commercial purposes only. Users have no sublicense rights unless expressly granted.
5.2. User Content
Users permitted to post or upload content (photos, reviews, descriptions) grant EpicGO a worldwide, irrevocable, perpetual, non-exclusive, transferable, royalty-free license with sublicensing rights to use, adapt, modify, distribute, and exploit such content to promote the Services.
6. Prohibited Activities
Users agree not to:
• Violate laws or third-party rights. • Submit false or misleading information. • Fail to honor user commitments (payments, returns, timely transactions). • Harm or threaten other community members. • Misuse Services for unauthorized commercial purposes or user recruitment. • Interfere with Service operations, security, or systems.
7. Host Specific Terms
7.1. Host Commitments
Hosts agree to provide safe, legally registered, insured, accurately represented, and roadworthy vehicles. Listings must be complete, accurate, and honored at quoted prices without cancellations for higher prices or unauthorized offerings.
7.2. Vehicle Information and Conditions
Hosts may only list vehicles they own or are authorized to share and must comply with laws governing vehicle telematics and data collection.
7.3. Pricing, Earnings, and Payments
Hosts set and adjust vehicle pricing, reflected in contracts with guests. EpicGO charges apply to each booking using registered payment methods.
8. Governing Law and Jurisdiction
These Terms of Service and any dispute, claim, or obligation arising out of or in connection with these Terms or their breach, termination, or validity shall be governed by and interpreted exclusively according to the laws of Romania.
The Parties agree that any disputes arising from or related to these Terms or the use of the Services shall be subject to the exclusive jurisdiction of the competent courts in Bucharest, Romania. Each Party irrevocably submits to the jurisdiction of these courts and waives any objections to jurisdiction, venue, or inconvenience of forum.
9. General Provisions
9.1. Termination
Users may discontinue Service use at any time. EpicGO may terminate Service access or listings for any lawful reason. Termination does not affect obligations or provisions that continue post-termination (e.g., disclaimers, limitations of liability).
9.2. Refunds
Users may request a refund through the mechanisms provided within the Services. Any refund request will be considered on a case-by-case basis and at EpicGO’s discretion, taking into account the circumstances of the booking and any information available to EpicGO. EpicGO’s objective is to safeguard users from fraudulent conduct or non-delivery of services, while recognizing that the Car Sharing Agreement is between the host and the guest and that EpicGO is not a party to, and does not guarantee performance of, that agreement. In assessing requests, EpicGO may consult community reviews, reputation signals, and other guidance or data available on or through the Services, together with communications between the parties and any material submitted in support of the request. Any refund that may be granted is not guaranteed, may be partial, and may exclude non-refundable charges or third-party processing costs. EpicGO’s determinations regarding refunds are made in its sole discretion and are final, without prejudice to any non-waivable rights users may have under mandatory applicable law.
9.3. No Vehicle Transfer or Assignment
These Terms do not constitute any transfer or assignment of vehicle rights or interests.
9.4. Disclaimers
Services are provided “as is,” without warranties. EpicGO does not provide vehicle renting or insurance services and is not responsible for user actions, vehicle conditions, or information accuracy. No warranty is implied for service availability, quality, reliability, or uninterrupted operation.
9.5. Limitation of Liability and Waiver
EpicGO’s aggregate liability arising from or related to these Terms or the Services is limited to amounts paid or earned by the user in the twelve (12) months immediately preceding the event giving rise to liability, or EUR 1,000, whichever is greater.
9.6. Indemnification
Users agree to indemnify EpicGO against claims, liabilities, damages, and expenses arising from Service use, violations of Terms, user content, interactions with other users, or vehicle bookings or listings.
9.7. Not a Rental Car Company
EpicGO operates solely as an online platform facilitating vehicle sharing between owners and guests, not as a vehicle rental or leasing service.
9.8. Severability and Non-Waiver
Invalid or unenforceable Terms provisions do not affect the remainder. Non-enforcement does not imply waiver of enforcement rights.
9.9. General
No employment, agency, or partnership is formed. Obligations or rights under these Terms cannot be delegated or transferred without EpicGO’s prior written consent.
